What it does
Changes how recall elections for state and local officials choose a replacement. Currently, a recall ballot has two questions: (1) should the official be removed, and (2) who should replace them? Prop 5 would eliminate the replacement election and instead allow the Governor or local governing body to appoint a temporary replacement until the next regularly scheduled election.
Creates or opens door to future tax/obligation?
N — election process change only; no tax or spending impact
What this means in practice
- If the Governor is recalled, the Lieutenant Governor would likely become acting governor until the next election
- If a state legislator or local official is recalled, their governing body would appoint a replacement
- No special replacement election would be held
Supporters say
- Saves the cost and disruption of special replacement elections
- Reduces confusion from two-question recall ballots
- Avoids situations where a recalled official is replaced by someone with very low support
Opponents say
- Takes the choice away from voters
- Appointment is less democratic than an election
- Could let a governor or board pick a replacement for political reasons
My Vote and Why
My Vote: No
Why: The people should always have a say as to who takes office. Replacing a recalled official by appointment removes that direct voter choice.
